Amendments to law on Moldova's Prosecutor General's Office enter into force

Chisinau, 23 July /MOLDPRES/ – The amendments to the Law of the Prosecutor's Office, aimed at regulating the vacancy of position of Prosecutor General, entered into force, on Tuesday, 23 July, with its publication in the Official Journal (MO).

According to new provisions, the procedure of designation of acting Prosecutor General will follow the following stages. The President of Moldova, at the proposal of the Superior Council of Prosecutors (CSP), will designate an acting Prosecutor General until it is organised the contest. The meeting of CSP to which the proposal is made shall be convened within a maximum of 03 days from the interruption of vacancy.

The President of Moldova will be able to reject the proposed candidature in the event of incontestable incompatibility of the candidate with the respective position, violation of the law or legal procedures for his/her selection.

In case of rejection of candidacy or if CSP does not propose the candidature within the indicated timeframe, the acting General Prosecutor will be appointed by presidential decree at the proposal of Parliament, with the opinion of CSP. The Parliament will propose the nomination within 03 days of rejection of candidate by the head or expiration of the deadline for CSP to propose nomination.

The law stipulates that the meeting of the CSP in which the proposal for appointment of acting Prosecutor General is made shall be convened within a maximum of 03 days from the entry into force of the new law.
