Chisinau, 21 August /MOLDPRES/- The Constitutional Court declared the request of Judge Domnica Manole to revise the Decision NoAG-6 of 19 August 2019 on election of the court’s head as inadmissible.
The request submitted on 20 August included suspicions about the secret balloting for the position of head of the Constitutional Court. The suspicions hanging on the legality of the adoption of the decisions cannot be verified and cannot be removed otherwise than through the review.
Examining the admissibility of the request, the Court found that the reason for the constitutional review was the emergence of new circumstances and asked for a clarification from Judge Liuba Șova, whose claims Domnica Manole based. Șova claimed to have received phone messages from a person whose identity was not disclose, messages that, however, she did not read before the voting process, but only on Monday (August 19, 2019), after working hours and stated that the vote was not influenced.
The court noted that in terms of time, no influence could be exercised on Judge Liuba Șova, in the vote cast for the Presidency of the Constitutional Court. The court also noted that Judge Liuba Șova stated she voted for her own candidacy.
According to the CCM decision on the election of the head, on August 19, four judges voted for the candidacy of Vladimir Turcan, two others opted for the candidacy of Liuba Sova.
