Moldovan government repeals four decisions on concession of Chisinau International Airport

Chisinau, 04 September /MOLDPRES/ – In its meeting of 04 September, the Cabinet of Ministers has repealed four Government decisions, approved in 2012 – 2013, on concession of Chisinau International Airport. In particular, there have been annulled decisions regarding the initiation of public – private partnership project for concession of the state – owned enterprise Chisinau International Airport on the approval of concession of its assets and conditions of their concession.

Also, there have been abrogated the decisions for approval of the Report on running and results of closed contest for selection of concessionaire of the assets of Chisinau International Airport and regarding reconfirmation of approval of concession of its assets.

The Government decision of 30 May 2012 approving the concession of assets under economic management of state enterprise Chisinau International Airport and the land associated with them, terms of their concession, as well as conditions for organising and conducting the closed competition for selecting concessionaire, "has suspended by the Constitutional Court (CC)”, has mentioned, within Executive meeting, Minister of Justice, Olesea Stamate.

Subsequently, the Government by its decision of 12 September 2013 approved the Report on running and results of closed contest for selecting concessionaire. And this governmental decision has been suspended by CC, which by the decision of 19 September prohibited the carrying out of any actions for concession of assets of Airport "until the case is settled with a final decision or resolution". Despite the prohibitions imposed by the High Court, the Government has since reconfirmed concession of assets of Chisinau International Airport and terms of their concession.

The judgments of September and October 2013 have been approved contrary to procedures established by law "by a resigning Government". Moreover, the CC has issued the decisions suspending the actions of Executive decisions of 30 May 2012 and 12 September 2013 on the basis of "economic or financial security of state", has also specified the Ministry of Justice (MJ).

According to ministry, for these reasons the financial obligations assumed under the conditions of concession of Chisinau International Airport strongly influences the policies of invested Government after the approval of this decision, but also of all Governments in upcoming 49 years, as long as the private partner does not ensure the public – private partnership.
