Superior Council of Magistracy to be refilled with three members

Chisinau, 30 January /MOLDPRES/- The promulgation decree and the law on amending some laws, setting the increase of the number of members of the Superior Council of Magistracy (CSM) will be published in the Official Journal of Moldova on 31 January. The documents will enter into force tomorrow.

According to the new amendments to the legislation, the CSM will be refilled with two members among teachers, who will be elected by the parliamentary commission, as well as a member among the judges, who will be elected by the General Assembly of Judges.

Thus, the number of CSM members will be expanded from 12 to 15. This is required in order to exclude incidents or blockages in activity, mostly at the quorum meeting.

Five members of the CSM among teachers are appointed by parliament, with majority vote based on the recommendations of the legal commission on rules and immunities, following a public contest.

Also, the document that will enter into force on 31 January provides a new way of selecting members by the General Assembly of Judges among judges. Thus, 4 members will be selected among judges working in the first court, 2 members – among the judges from the court of appeal and 1 member - the judges of the Supreme Court of Justice.

At the same time, if the interim position of president of the CSM occurs, it will be provided by the senior dean among the judging members.

Another amendment regulates the conditions that the candidate must meet in order to be elected as a member of the CSM among the judges. The magistrates must have worked as a judge for at least 3 years, at the last evaluation must have obtained the qualification "very well" and has not been disciplined in the last 3 years. Also, the candidates will submit besides CV a letter of motivation, the project on the main goals they will follow in the case of election as a member of the CSM.

Within 30 days from the date of entry into force of this law, the legal committee on rules and immunities will organize under the legislation a competition for selection of the CSM members among teachers for a term of 4 years. At the same time, the CSM will announce the date of the General Assembly of Judges for the election of the member among judges.
