Contest for election of CSM members must be removed from parliament's guardianship

Chisinau, 18 February /MOLDPRES/- Minister of Justice Fadei Nagacevschi believes that the election of the non-judicial members of the Supreme Council of Magistracy / CSM / should be removed from the parliament's guardianship.

He said that the parliament plays a decisive role in the election of non-judicial members of the CSM. "Parliament’s vote is decisive, therefore, want it or not, this is a political vote", he said.

Nagacevschi notes that to exclude the political factor, the Constitution should be changed. "The contest must be removed from under the parliament, and for this the Constitution must be amended. The Supreme Law says that non-judicial members are elected by Parliament. The problem is not in the commission of experts, but in the implementation of the law and good faith of those who will select ”, he said.

The legal committee on rules and immunities announced on 5 February 2020 a public competition for the positions of non-judge member of CSM.

Under the legislation, the five members of CSM are elected through a contest among teachers and are appointed by parliament with a majority vote based on proposals of the legal committee on rules and immunities.
