Moldovan Liberal Democratic MPs submit notice to top court

Chisinau, 4 November /MOLDPRES/ - The MPs of the parliamentary faction of the Liberal Democratic Party (PLDM) today submitted a notice to the Constitutional Court (CC), thereby demanding interpretation of the Article 96, paragraph 2, Article 98, paragraph 3 and Article 106 of the Constitution and exercising the control of constitutionality of the parliament decision from 29 October 2015, under which the government was dismissed.

The PLDM lawmakers asked CC to give its ruling on the following aspects: whether the cabinet can be dismissed under censure motion, the ground of which represents suspicions of corruption which have not been proved. And whether the parliament can adopt a censure motion based on suspicions of corruption against a nominal person, who exercises the duties of prime minister or government member, without having information from prosecution bodies on a reasonable suspicion in this respect.

The signatories to the notice deem it absolutely necessary that the Constitutional Court gives a detailed ruling, in order to rule out a deliberate creation by political subjects of precedents of dismissing a cabinet just based on alleged suspicions of corruption, unproved by law-enforcement institutions.

The authors also demand that CC examines the notice urgently.
