Moldovan top court says procedure of stripping Liberal Democrat MP of immunity constitutional

Chisinau, 17 November /MOLDPRES/ - The Constitutional Court (CC) today considered a notification submitted by a group of MPs of the Liberal Democratic Party (PLDM). CC ruled that the procedure of stripping PLDM lawmaker Vlad Filat of immunity had been constitutional.
CC decided that the requirements, provided for in the Constitution for the adoption of the parliament decisions, in the sense of quorum for adoption and way of voting, had been met when passing the decision contested by PLDM. As for the rest of the procedures set by the parliament's regulation, the Court is not competent to issue a ruling.
Also today, the Constitutional Court declared as unconstitutional the paragraphs (6) and (7), as well as the word "secret" of the paragraph (8) from the Article 97 of the parliament's regulation, passed under the Law No 797-XIII from 2 April 1996, as well as the paragraph (5) from Article 10 of the Law No 39-XIII from 7 April 1994 on the statute of the MP.
Therefore, the Court turned down as groundless the concerned notification and declared constitutional the parliament decision No 172 from 15 October 2015 on agreeing to lifting the parliamentary immunity of lawmaker Vladimir Filat.
The Constitutional Court's decision is final, cannot be subject to any appeal and enters into force on the date of adoption.
