Moldovan top court rules government can take responsibility on more draft laws

Chisinau, 2 March /MOLDPRES/ - The government can take responsibility on more draft laws simultaneously, on certain conditions, under a today’s ruling by the Constitutional Court (CC).
According to the CC decision, the government can take responsibility on more draft laws, on condition that the adoption is an extreme measure, prompted by the urgency in carrying out the provisions contained in the laws on which the cabinet took responsibility.
‘’Another condition would be the need that the regulation be passed as quickly as possible, and the immediate enforcement of the laws be made in a single sector of regulation,’’ the CC ruling says.
Under the same decision, the Moldovan president cannot submit to parliament, for consideration, before promulgation, a law on which the government has taken responsibility.
‘’If the head of state considers that the law adopted by government taking responsibility is unconstitutional, he/she can notify the Constitutional Court,’’ the Court’s ruling says.
The Constitutional Court’s decision is final, cannot be subjected to any way of appeal, enters into force on the date of adoption and is published in the Official Journal of Moldova.
On 4 June 2015, MPs Mihai Ghimpu and Valeriu Munteanu submitted a notification to CC on interpreting the provisions of Moldova’s Constitution on the taking responsibility by the government.
