Chisinau, 2 June /MOLDPRES/- The decision of the Constitutional Court (CC) on permanent neutrality of Moldova (Article 11 of the Constitution) was published today in the Official Journal.
The decision taken by the court’s magistrates on 3 May states that deployment on the territory of Moldova of any troops or military bases, directed and controlled by foreign states, is unconstitutional.
The magistrates’ decision also reads that the military occupation of a part of Moldovan territory at the moment of declaration of neutrality, as well as the lack of recognition of international guarantees of this statute do not affect the validity of the constitutional provision on neutrality, and in case of a threat to such fundamental constitutional values, such as national independence, territorial integrity or state security, the Moldovan authorities are obliged to take all necessary measures, including military ones, which would allow to defend effectively against them.
Under the decision, Moldova’s participation in collective security systems, like the United Nations security system, peacekeeping operations, humanitarian operations, is not in contradiction with the status of neutrality.
The CC’s decision is final and cannot be subject to any appeal.
