Moldovan cabinet approves amendment to law on temporary incapacity for work after top court ruling

Chisinau, 23 June /MOLDPRES/ - The wife maintained by an insured husband will benefit from maternity allowance, if she is not employed and has no ensured income on the date of providing the maternity leave, according to an amendment made to the law on incapacity for work, approved by the cabinet today.
Under the draft, “the wife maintained by an insured husband will benefit from maternity allowance, if she is not employed and has no ensured income on the date of providing the maternity leave, which is confirmed by the record of service and the written declaration on one’s own responsibility that she is not insured by the concerned risk.”
On 9 February 2017, the Constitutional Court declared unconstitutional the Article 16, paragraph 5 of the law on allowances for incapacity for work, which saw that “the wife is maintained by the insured husband if, during nine consecutive months before the month of providing the maternity leave, she was not employed or does not have an income equivalent to four monthly salaries or if she lost the status of insured person.”
According to the information presented by the National Social Insurances House, the spending needed to enforce the draft law is estimated at 182 million lei in 2017, more than 200 million lei in 2018 and about 218 million lei in 2019.
The draft law is to be submitted to parliament for consideration.
