Commentary on European top court's rulings launched in Moldovan capital

Chisinau, 29 June /MOLDPRES/ - A book titled, „Convenția Europeană a Drepturilor Omului. Comentariu asupra hotărîrilor Curții Europene a Drepturilor Omului versus Republica Moldova” (European Convention on Human Rights. Commentary on Rulings by European Court of Human Rights Versus Republic of Moldova) was launched by the National Justice Institute (INJ) and Supreme Court of Justice (CSJ) in Chisinau today.   

The work analyzes the decisions themselves by the European Court vs Moldova. The book’s authors are CSJ President Mihai Poalelungi, a PhD in law, Diana Sircu, INJ instructors Olga Dorul, Alexandra Nica, Lilia Grimalschi and Stas Splavnic.     

At the launch event, the work’s initiator, CSJ President Mihai Poalelungi said that authors had worked on this book during two years. “We are glad that we have managed to make this study, which I am sure that it will have a positive impact in the society. The commentary is dedicated to all jurists, but first all to judges, prosecutors, lawyers and the academic environment. Any jurist who is going to read the book seriously will have possibility to improve his/her knowledge in the theoretical field and then in the practical one,” the CSJ president noted.     

At the event, Head of the Council of Europe Office in Chisinau Jose Luis Herrero said that “he hopes that this work will contribute to the additional documentation of all sides involved in the juridical process, so that, in the end, the number of cases sent to European Court of Human Rights (ECHR) decreases significantly and decisions taken by Moldovan judges meet the international law standards.”  

Attending the law ceremony, INJ Director Diana Scobioala said that this textbook was meant to guide any actor in the justice sector, when he/she is facing a particular problem in the enforcement of the European Convention. “The authors did not make copy-pastes in rulings; they analyzed them thoroughly and came up with recommendations to avoid certain situations.  At the same time, the reasonings of the Court were pointed out and namely what these judges relied on when taking a decision,” Scobioala said.  

“This is a work which will contribute to the improvement of the image of the judicial system from our country. Let us be patient, read this commentary and have as few as possible rulings on Moldova’s conviction at the Court. Those to whom this book is meant should study it and apply it into practice successfully,” the head of the Superior Council of Prosecutors, Mircea Rosioru, said.   

The book, European Convention on Human Rights. Commentary on Rulings by European Court of Human Rights Versus Republic of Moldova, was edited with the financial support of the Council of Europe. One thousand copies were edited. The work will be subsequently accessible in the online variant too.
