Term of fulfilling court rulings to be shortened in Moldova

Chisinau, 20 October /MOLDPRES/ - The court rulings, in which the state has capacity of debtor, will be fulfilled in a three-month period and not in a half-a-year one, as it was before. The parliament adopted a draft law in the final reading today, which sees amendment and completion of legislative acts.
The document was worked out by the Justice Ministry, in order to fulfill a decision by the Constitutional Court for the constitutionality control of provisions concerning the satisfaction of requirements against the state.
The Constitutional Court in 2016 ruled that some provisions of the present legislation reduce the area of fulfillment of final court rulings, contrary to the provisions of the Article 120 of the Constitution. At that time, the Court decided that the three-month fulfillment term was enough and reasonable and pointed to the fact that a difference must be established between the situations when the suspension of the court ruling is demanded by private law private persons and legal entities and the ones when this suspension is demanded by public law legal entities.
