Moldovan parliament adopts completion of law on competition

Chisinau, 23 November /MOLDPRES/ – The national legislation will be supplemented with rules on the assessment of concentrations within mass media field. The Parliament has voted to complete the Competition Law in a final reading today.
According to the new regulations, the special legislation within mass media can provide thresholds for the notification of mergers other than those currently stipulated in the legislation. Currently, Article 22 (1) of the Competition Law provides that the economic concentration operations are subject to evaluation and are to be notified to the Competition Council prior to implementation, when the cumulative total turnover achieved by the enterprises involved in the year prior to the operation exceeds MDL 25 million and there are at least two enterprises involved in the operation that each made a total turnover in Moldova more than MDL 10 million in the year prior to the operation.
The document also provides that special mass media law may provide for market shares that presume the existence of a dominant position.
Also, the Audiovisual Council will report annually to the Competition Council by 01 March on the actual beneficiaries in audiovisual field, with annexation of copies of the relevant documents held.
The Audiovisual Council will notify the Competition Council about the facts found with signs of economic concentration in the audiovisual field and make available all the relevant info held.
