Ban on sale of cigarettes nearby schools, hospitals constitutional in Moldova

Chisinau, 25 April /MOLDPRES/ - The Constitutional Court’s (CCM) decision on control of constitutionality of the Article 25, paragraph 6 of the Law No 278 from 14 December 2007 on tobacco control will be published in the Official Journal of Moldova on 26 April.
Under the CCM’s decision, the ban on the commercialization of tobacco products nearby education and medical institutions is constitutional. The top court considered a notification submitted by a former lawmaker, Simion Grisciuc. He said that the present provisions do not ensure a fair competition between traders, as the law bans the trade with tobacco nearby schools and hospitals only in rooms smaller than 20 square metres, without affecting the trade units with a bigger area.
The Court considered that the stationary commercial units had more guarantees than the provisional trade units and said that the present differentiated treatment was justified in this case.
The Constitutional Court turned down the notification submitted by Simion Grisciuc and recognized as constitutional the Article 25 from the law on tobacco control.
