Collective dismissal procedure adjusted to EU one in Moldova

Chisinau, 21 June /MOLDPRES/ - A decree on the promulgation and the law seeing the amendment and completion of Moldova’s Labour Code will be published in the 22 June issue of the Official Journal (Monitorul Oficial)   

Following amendments made to the Labour Code, at the reorganization or liquidation of the unit, which implies collective dismissals, the employer is obliged to inform the wage earners and the Labour Force Employment Agency by 30 calendar days ahead of starting the procedures at the earliest.  

Thus, the employer will sent to the Labour Force Employment Agency a notification comprising information on dismissals and will submit a copy of the notification to employees’ representatives.  

The employer will also start consultations with employees’ representatives on possibilities of avoiding collective dismissals or reducing the number of wage earners hit, as well as of mitigating the consequences of dismissals through resorting to social measures of support, such as redistribution or re-qualification of dismissed employees.   

The criteria according to which the collective dismissals are to be described, as well as the obligations of the participants in procedures of collective dismissals were included in the article titled, Guarantees in case of collective dismissals, from the Labour Code.
