President Igor Dodon submitted a notification on the matter. He claimed that the law prohibiting broadcasters and distributors of media information services to broadcast informative, analytical, military and political programmes in other countries that those which have ratified the European Convention on cross-border television is contrary to Articles 31, 32, 34 and 54 of the Constitution.
Following the examination, the court found that the last amendment to the Broadcasting Code may help counter hostile information operations against the society of the Republic of Moldova and to ensure the correct information of citizens.
The court had no reason to believe that the impact of the prohibition on the issue amounts to disproportionate interference with the freedom of expression or the right of access to such information.
The court rejected the president’s notification and recognized constitutionally the law no257 of 22 December 2017 on the Broadcasting Code.
