Moldova to possess administrative code

Chisinau, 05 July /MOLDPRES/ – For the first time, Moldova will have an Administrative Code which will define functioning of public administration institutions and authorities. A draft law in this regard has been adopted in final reading by Parliament today.  

The initiative belongs to a group of MPs and aims to systematise all legal regulations on administrative procedure and those relating to administrative litigation in a single legislative act as to ensure clarity, coherence and accessibility.

The new Administrative Code establishes the goal of administrative procedure, procedure for administrative procedure, participants in administrative procedure, administrative procedures, administrative operations, administrative contracts, execution and observance of administrative acts, administrative control and appeals.

The document adopted today will regulate issuance of administrative acts by public authorities, mechanisms for resolving petitions addressed by citizens, and encompass all legislative acts that currently lay down the legal relations of administrative law. For the first time, it will be regulated refusal to receive or examine an application.

Similarly, for the first time, it will be mandatory for public authorities to draw up administrative file. The new Code will also regulate notification procedure in non – contentious procedure and it will established possibility of concluding agreement between parties in both non – contentious and contentious proceedings.

The draft Administrative Code is structured in four books dealing with uniformity of legal solutions and regulation of legal situations signaled by administrative jurisprudence. It also provides for simplification of means of action of public administration throughout coherence and predictability of procedures and ensuring stability of administrative procedures.

The Administrative Code of Moldova will enter into force on 01 April 2019.
