Moldovan Democrats submit notification to top court, demanding interpretation of Fundamental Law articles

Chisinau, 28 February /MOLDPRES/ - A lawmaker of the Democratic Party (PDM), Sergiu Sirbu, today submitted a notification to the Constitutional Court (CCM), thereby demanding that the court interprets three articles of the Constitution on the government’s work.
In the notification submitted to CCM, Sirbu asked the top court to give its opinion on the Articles 102, 103 and 106 of the Constitution under the following aspect: “Is it allowed to perpetuate a long-term institutional parliamentary blockage and power vacuum in the case government’s resignation as a result of the validation of the new parliament, impossibility to create a government, which triggered snap parliamentary polls? Is the acting cabinet obliged to take all needed measures to ensure the continuity of the power, ensure the economic and financial security, ensure the national security and defence capacity of the country, in case of blockage of the parliament’s work and through what constitutional mechanisms? Can the acting government, if the legislative power vacuum is established, issue normative acts, including in the sector of regulation of the ordinary and organic laws, in order to ensure the continuity of power, ensure the economic and financial security, ensure the national security and defence capacity of the country?” the notification reads.
The PDM MP said that the notification submitted today was aimed at elucidating the exact sense of some constitutional provisions dealing with the government’s powers of ensuring continuity of exercising the power and settling the problems in the state, if a deep political crisis is created. According to the Democrat lawmaker, the CCM’s interpretation will allow avoiding an eventual power vacuum.
